Terms and Conditions

Our goal is to make your purchasing experience easy and efficient, so we can get you on your way to your holiday of a lifetime as quickly as possible.

These Booking Conditions apply to all bookings accepted by Liberty Tours Pty Ltd, trading as Liberty Tours, Luminosity, or Luminosity Travel, hereafter referred to as The Agent. The Agent is not responsible for any verbal comment or assurance made to the client. The Agent is not a transport, tour, cruise, event, or accommodation provider; it acts only as an agent for service providers. No warranty or representation regarding the standard of any service or product is given. All bookings are made subject to the terms and conditions and limitations of liability imposed by those service providers. It is your responsibility to familiarise yourself with the terms and conditions and limitations of liability of those service providers as you will be bound by them. If any travel service provider is unable to provide the services which you have purchased from them, your remedy shall lie against the provider and not The Agent.

Signing this document, either physically or electronically or payment of a booking deposit or tour price represents your acceptance of these terms and conditions.

Travel Insurance

The Agent is not liable in any regard for your failure to adequately insure yourself, and you agree to indemnify and hold The Agent harmless for any expenses or delays incurred as a result of your failure to adequately insure yourself. We strongly recommend that clients purchase travel insurance at the time of booking.

Airline bookings

Airfares quoted are ONLY valid on the date of booking and are subject to change, withdrawal, or alteration by airlines without notice, before the final ticketing process being completed. Any pre-reserved seating is subject to a fee set by airlines. Individual airlines have policies whereby they make a charge for advance seat selection. Conditions do apply and these can be obtained by contacting our consultants or by contacting the airline directly, via phone or the airline’s web site.

Taxes

Government tax, airport charge, fuel surcharges are current at the time of booking but are subject to change without notice. Airport and departure taxes are included in the airfare or included within the Government taxes or airport charges. Additional taxes may be applicable and can change depending on the airline and is out of The Agent’s control.

Changes in prices and itineraries

Prices are fixed once the deposit is received, with the following exceptions:

The price of the booking may change at any time up to 30 days before departure due to currency fluctuations or if any new surcharges, fees or taxes are introduced or if any existing surcharges, fees or taxes are varied, even after all or part of the quoted price of the booking has been paid. If we have to change any part of your booking for reasons beyond our control, for example, if an airline changes its schedules, if a hotelier overbooks, or if there are any changes in applicable surcharges, fees or taxes, we will notify you.

Deposit and final payments

All deposits paid to The Agent for any travel arrangements are non-refundable. The amount of the initial deposit will be advised and payable when you make the reservation. You will be notified at the time of your reservation if any additional deposit requirements apply. The date for full payment for your holiday package will be advised when you make the reservation. If for any reason your balance is not received by us by the due date, we reserve the right to treat your booking as cancelled and to apply the appropriate cancellation charges. A deposit holds the services requested but does not guarantee prices.

Cooling-off period

You may cancel your booking within seven days of paying your initial deposit and receive a full refund. At the end of the cooling-off period, it will be deemed that you accept the terms and conditions of all suppliers, where applicable.

This condition does not apply to airfares, which are governed by supplier terms and conditions from the time of purchase.

Credit Card surcharge

If you pay The Agent by credit or debit card the following non-refundable surcharge will be added to your booking price. The surcharge will never exceed the amount charged by the credit card merchant:

  • Visa, Master Card: 1.2%
  • American Express: 2.3%

Cancellation by Us

Liberty Tours reserves the right to cancel or vary a tour prior to departure due to insufficient numbers or other unforeseen circumstances. In such an event alternative guaranteed travel dates will be offered. Should these options not be acceptable Liberty Tours will refund the full price paid less visa cost.The Agent reserves the right to cancel or vary a tour prior to departure due to insufficient numbers or other unforeseen circumstances. Cancellation by You:

Should you decide to cancel a booking, notification in writing must be given to The Agent. There will be cancellation fees charged by airlines, hotels, and ground/cruise operators amounting to all or part of the cost paid. Cancellation will incur a fee of 10% of the total booking amount plus and booking amounts paid to operators that are non-recoverable, due to cancellation terms, insolvency, or any other reason.

If the holiday package has commenced, due to sickness or other reasons, no refunds are. No refunds are available in respect of lost or unused tickets, hotel coupons, meal or any services not utilized.

If you are a no-show or do not avail yourself of an airfare or other travel product, or are denied boarding for any reason, no refund will be payable.

Amendment Fee

Any amendment made to a confirmed tour or itinerary will result in The Agent amendment service fee of $50 per person, and there may be change fees charged by airlines according to airline’s fare rule, and wholesale service fee, hotels and ground/cruise operators amounting to all or part of the cost paid.  Transferring from one tour to another tour will incur a $150 fee per person.

Items Not Included In Your Tour Cost

The tour costs quoted exclude items not specifically referred to in the tour itinerary unless specified including but not limited to, pre-travel documentation, travel insurance, visa application fee, airport departure taxes, fuel surcharge, road and airport construction taxes, excess baggage charges, porter tips, tour guide & driver tips, gratuities, meals and interstate/intrastate travel arrangements to and from home town and departure city, items of a personal nature such as laundry, dry cleaning, beverages, personal accident, and medical expenses, incidental expenses, taxi where not part of regular transfer, telephone and telecommunication charges.

Tour Operation

Although The Agent will endeavour to ensure that tours are available as advertised, an express condition of making a reservation is the acceptance by the client that tour itineraries and schedules, advertised accommodation, sightseeing programs and modes of transportation as outlined in this brochure and our itinerary paper and/or supplied in pre-departure information are subject to change without prior notice. Air travel, coach journeys and other forms of transport and hotel accommodation are provided by independent operators and all bookings through The Agent are subject to the terms, conditions and limitations of carriers, hoteliers, and other service providers. The itineraries are subject to change upon local arrangement or service provider schedule change.

Tour Variations

Although The Agent will use reasonable efforts to operate the tour as close as possible to your itinerary, changes or substitutions may be necessary for reasons outside our control. These circumstances may include, but are not limited to:

i) Road or weather conditions

ii) National or local holidays affecting closure of public buildings and attractions

iii) Strikes or civil disturbances

Cruise itineraries may be varied due to high or low water levels, flooding, unscheduled vessel maintenance, or any other circumstance beyond our control.

Immigration

You are responsible for all visa, passport, immigration, quarantine, customs, health and other requirements of the countries visited or transited. A valid passport (with at least six months validity) must be carried by each person. The Agent is not responsible for your failure to ensure that you comply with these requirements.

Health Requirements

Clients should familiarize themselves with any health requirement applicable to areas they intend to visit. The client is solely responsible for compliance with vaccination and other health requirements of governments in countries visited or transited.

Baggage Regulations and Allowance

The amount of baggage will depend on the airline and their conditions of carriage. You will be notified on how much allowance you receive. Excess baggage charges are the sole responsibility of the client.

Purchases on tour

During the tour, shopping for local products may be arranged. Any purchase during the tour period is your own decision, Liberty Tours will not responsible for any fake or faulty goods purchased.

Limit of Liability

To the extent permitted by law, The Agent excludes all liability for any loss or damage whatsoever (including but not limited to physical and psychological injury, and loss or damage to property of whatever nature) that may arise in any way in connection with the offer or supply of goods or services through The Agent or any third parties, or in connection with the supply of such goods or services. If the law implies a condition or warranty that cannot be excluded, The Agent’s liability for a breach of the condition or warranty will be limited as determined by The Agent to the resupplying the relevant goods or services.

Events beyond our control: The Agent does not accept liability whatsoever for injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by tour variations or interruptions caused by road, river or weather conditions; national or local holidays affecting the closure of public buildings and attractions; strikes, Force Majeure events; high water levels; low water levels; flooding; lock closures; unscheduled vessel or vehicle maintenance or for any other circumstances beyond The Agent’s control; forces of nature; illness; flight schedule changes or cancellations; loss of luggage; epidemics or pandemics; political unrest; accidents; acts of terrorism or other criminal acts; noise, vibration, and odour from external factors during your trip and any changes to government visa or travel requirements.

Destination conditions

The Agent makes no representations as to the safety, conditions, or other issues that may exist at any destination. You should obtain independent travel advice, including from the Australian Department of Foreign Affairs and Trade (www.smartraveller.gov.au)

Law of contract

These booking conditions are governed by the laws of New South Wales, Australia and any action arising under them or in any way connected with the holiday may be brought only in a court in New South Wales, subject to any law which is expressly inconsistent with this.

Complaints or Claims

Dissatisfaction about arrangements or services made/delivered overseas must be made as soon as the complaint or claim arises, and with the personnel involved in the incident or situation. Unresolved Complaints or Claims:  If the complaint or claim is not resolved to the client’s satisfaction, the client must document the complaint or claim in writing by giving/sending a copy to the local representative, with a copy to The Agent Service no later than 30 days following the scheduled completion date of the tour. The client agrees and accepts this condition, and waives the right to register any complaint or claim more than 30 days following the scheduled completion date of the tour. 

Effective date

These terms and conditions apply to any agreement entered into on or after 22 July 2020 unless superseded.
